في ظل صعوبة الوضع الانساني والأمني في الصومال، باتت المرأة الصومالية، تتعرض لإنتهاكات خطيرة، قد ترقي الي مستوى جرائم ضد الانسانية، حيث وقعت ضحية لأبشع أنواع العنف الجسدي واللفظي، كالاغتصاب والتعذيب والتهديد بالطلاق، إضافة الي حرمانها من بعض الحقوق الأساسية التي تكفلها الشريعة الاسلامية، وسط صمت رسمي وشعبي رهيب بحجة حفظ أسرار المرأة وعدم تعريض مستقبلها للخطر الا أن هذا الصمت يمكن اعتباره في بعض الأحيان، تباطؤا ومشاركة في الجريمة.
هناك قصص مرعبة تتحدث عن حالات اغتصاب وتعذيب جسدي تقع باستمرار في معسكرات النزوح والقرى والنجوع، بعيدا عن أعين الاعلام، ورقابة الدولة، ولا يصل من هذه الوقائع الي الدوائر المتختصة الا النزر القليل، وما يصل اليها أو تسرب الي الاعلام لا تحصل عادة على احكام عادلة، بل تختفي ملفاتها في رفوف الجهات المختصة.
قبل أيام وجيزة، تداولت مواقع على الانترنت، مقطع فيذيو لفتاة تقول إنها صحافية صومالية وقعت ضحية لإعتداء جنسي، و “انتهاك للعرض” من قبل أشخاص ينتمون الي جهات حكومية.
هذه الفتاة التي تدعى فاظمة عبد القادر والبالغة من العمر 19 عاما، تتهم اشخاصا يعملون لدى وزارة الاعلام الصومالية باغتصابها والاعتداء عليها تحت تهديد السلاح، الا أن االحكومة، لم تعط لهذه القضية بالاهتمام المطلوب ووصفته بأنه شأن قانوني ولا يحق لها أن تتدخل احتراما لمبدأ فصل السلطات، في حين يتخوف البعض من أن تؤول قضية الفتاة الي ماآلت اليه قضايا مماثلة ضاعت في دياجير الفوضى واخطبوط الفساد في البلاد، خاصة بعد ألقاء القبض على الفتاة وايداعها السجن على ذمة التحقيق مع إثنين من صحافيين متهمين بنشر خبرها، بينما تم اطلاق سراح المتهمين الأساسيين بالاعتداء على الفتاة، بكفالة، وذلك وفقا لما نشرته وكالة الشرق الأوسط.
تأتي قضية “فاطمة” بعد عدة أشهر من ابلاغ حالتيين مماثلتين لقضيتها للمحاكم المختصة في مقديشو. فالأولي كانت في شهر أغسطس الماضي، عندما اتهمت شابة جنودا من القوات الصومالية باختطافها وتسليمها الي عناصر من بعثة الاتحاد الافريقي الذين قاموا باغتصابها تكرار قبل القائها في الشارع، وذلك طبقا لما اعلنت عنه هيومن رايتس ووتش التي دعت الحكومة الصومالية الي فتح تحقيق جاد لقضية الشابة، لكن لحد الآن لم يتم كشف ومعاقبة مرتكبي تلك الجريمة، كما لم يتم تنفيذ ما وعدت به وزيرة الشؤون الاجتماعية الدكتورة مريم قاسم من ملاحقة المجرمين ومثولهم أمام العدالة.
والقضية الثانية ظهرت في شهر يناير الماضي حين اعتقلت الشرطة الصحفي عبدالعزيز نور بعد إجرائه لقاء صحفيا مع سيدة اتهمت جنودا حكوميين باغتصابها. فقد اطلق سراح الصحفي عبدالعزيز بعد تدخل من الرئاسة الصومالية الا ان قضية السيدة لم تجد طريقها الي العدالة الناجزة، وتلاشت في غمرة الأحداث التي تقع في البلاد تباعا، وأصبحت خبر كان.
هذه الأحداث ليست الا نموذجا من حالات انتهاك خطيرة لحقوق المراة الصومالية التي خرجت الي العلن، لكن ما تحفي صدور آلاف من النساء في مخيمات النزوح والبوادي أكثر وأشد إيلاما غير انها أنها تفتقر الي التوثيق وايجاد اعترافات من اللاتي تتعرضن لتلك الانتهاكات.
عندما نتحدث عن الانتهاكات الصارخة ضد المرأة لا نقصد فقط، الاغتصاب الذي أركزه في هذا المقال، وانما تشمل أيضا العنف الجسدي واللفظي والحرمان من الحقوق التي تكفلتها الشريعة الاسلامية، بحيث تتعرض المرأة الصومالية، لممارسات بشعة وتمييزية داخل الأسر وفي مجالات العمل والتعليم، ومن هذه الممارسات التي تتعرض النساء في الصومال منع حقوقهن من الميراث، وقطع أو كسر بعض اعضاء اجسادهن من قبل الأزواج أو مقربين منهن.
أسباب ظاهرة الاغتصاب وانعكاساتها الخطيرة على المجتمع
لظاهرة الاغتصاب التي يعاني منها قطاع عريض من النساء في مختلف ارجاء البلاد أسباب متعدوة وإنعكاسات خطيرة علي المجتمع الصومالي. ومن أهم العوامل المسببة لهذه الظاهرة هي:
1- إنتشار الفوضي وتدني المستوى الأمني في بعض المناطق نتيجة ضعف الأجهزة الأمنية المسؤولة عن تصدي الجرائم قبل حدوثها والقبض على المجرمين وردعهم.
2- عدم توخي الفتيات الحذر من الذهاب لوحدهن الي الأماكن الخطرة أمنيا، حيث تمشي الفتاة أحيانا لمفردها في وقت متأخر من الليل في مواقع خطرة، ما يؤدي في النهاية أن تقع فريسةً لهذا النوع من الإجرام.
3- ضعف الوازع الديني وغياب التوعية والتربية الصحيحة لدي كثير من الأجيال الذين ولدوا أو تربو في في ظل الحرب الأهلية وأنعدام الأمن والقانون .
4- صعوبة الزواج نتيجة كثرة تكاليفه، وتفاقم نسبة البطالة بين الشباب الراغبين في الزواج.
5- تزايد نسبة متعاطي المخدرات والمسكرات، ولا سيما نبات القات التى تلعب دورا بارزا في تفكفك الأسر، وضياع الشباب ما يدفعهم اللجوء الي ممارسة أعمال البلطجة والاعتداء على الحرائر .
6- عدم تطبيق الشر يعة والقانون بشكل يردع من تسول نفسه في ارتكاب جرائم ضد المرأة، وغياب روح المسؤولية لدى الجهات المختصة في ابلاغ وتحقق تلك الجرائم قبل وأثناء وقوعها وتقديم المتورطين فيها إلي العدالة.
أما إنعكاسات ظاهرة الاغتصاب على المجتمع الصومالي متعددة وخطيرة، حيث اعتبر البعض أن إنتشار هذه الظاهرة أمر خطير يمسّ كرامة المجتمع الصومالي، ما يجعل لزاما على الحكومة ووجهاء المجتمع بإتخاذ كافة التدابير والإجراءات اللازمة لحل هذه القضية والحيلولة دون تدهورها قبل فوات الأوان ولات حين مناص.
صيحيح، أن بعض منظمات المجتمع المدني وقيادات في الحكومة الفذرالية تحاول مواجهة هذا الخطر الداهم، حيث تتم أحيانا اعلان مبادرات لمكافحة هذه الظاهرة الا أن الإجراءات التي اتخذت حتى الآن لا ترقى الي المستوى المطلوب، وليست لها تأثير كبير على أر ض الواقع.
رسالة الي الحكومة ومؤسسات المجتمع المدني
من أجل معالجة ظاهرة الاغتصاب لا بد أن نأخذ بعين الإعتبار أنها قضية إجتماعية يجب على الجميع الاهتمام بها والسعي الي ايجاد حلول ناجعة لها، ولا يمكن أن تثمر جهود الأسرة، وسعيها في حماية بناتها، بمعزل عن المؤ سسات المجتمعية الأخري، ولا سيما المؤ سسات المعنية بحقوق الانسان ودون أن يوجد تنسيقا كاملا مع الحكومة ومختلف ألوان الطيف السياسي والثقافي في البلاد.
ومن هنا ينبغي للحكومة ان تتحمل مسؤوليتها تجاه حماية أبنائها وحقوق المراة التي تمثل اليوم أكثر من نصف المجتمع، وبالتالي فعليها اعلان حملة واسعة لمواجهة ظاهرة الاغتصاب، والبحث عن حلول لمسبباتها والدوافع الحقيقية وراء انتشارها، كما ينبغي لها أن تعمل في تطوير الأجهزة الأمنية والقضائية بشكل يمكنهما من تنفيذ القانون علي المجرمين، وانزالهم بأشد العقوبات، بالاضافة الي معالجة مشاكل الشباب وتوفير فرص العمل لهم بغية منعهم من الانشغال بالرذائل، لأن (الفراغة مفسدة)، ما لم يتم الاستفادة منها بشكل جيد.
