بيت الزكاة الصومالي

الزكاة ركن من أركان الإسلام العظمي وفريضة من فرائضه المقررة على كل مال بلغ النصاب وحال عليه الحول ،وهو يشمل المنقول وغير المنقول والأثمان والحيوان بأصنافه المختلفة والمطعوم وعروض التجارة وما في باطن الأرض وغير ذلك من الأصناف الواجبة على الزكاة ، وأما التفاصيل والأحكام المصاحبة لهذه الفريضة في موجودة في كتب الحديث والفقه .

وأما مستحقي الزكاة ومصارفها فقد تولى المولى جل في علاه في تحديدهم فقال تعالى ﴿ إِنَّمَا الصَّدَقاتُ لِلفُقَراءِ وَالمَساكينِ وَالعامِلينَ عَلَيها وَالمُؤَلَّفَةِ قُلوبُهُم وَفِي الرِّقابِ وَالغارِمينَ وَفي سَبيلِ اللَّهِ وَابنِ السَّبيلِ فَريضَةً مِنَ اللَّهِ وَاللَّهُ عَليمٌ حَكيمٌ﴾ التوبة ٦٠ .

الزكاة جزء من نظام التكافل الاجتماعي الإسلامي ، لأن الإسلام يوجب على الدولة المسلمة أن توفر عملا ومهنة أو أن تهيئ بيئتة وتذلل وتيسر أسبابه لكل قادر حسب مستواه العلمي والذهني والجسدي كي يعول على نفسه وعلى من تجب عليه نفقتهم ، فمن كان حاله هكذا فلا حق له في الزكاة في هذا الظرف إلا إذا تغير وضعه ، ولذلك ورد في حديث عبدالله بن عمر قال رسول الله (ص) ” لا تحل الصدقة لغني ولا لذي مرة سوي” حديث حسن  ، وعن عبيد الله بن عدي بن الخيار قال أخبرني رجلان أنهما أتيا النبي ( ص) في حجة الوداع وهو يقسم الصدقة فسألاه منها ” فرفع فينا البصر وخفضه فرآنا جلدين” فقال ” إن شئتما أعطيتكما ولا حظ فيها لغني ولا لقوي مكتسب ” إسناده جيد .

وأما من لا يستطيع العمل وإعالة نفسه بسبب عجز أو مرض مزمن أو غير ذلك من الأسباب التى تحول بينه وبين التكسب ولا يجد قريبا ينفق عليه من باب الوجوب والالتزام ، أو مدخوله لا يغطي حاجته  ومصاريفه ، أو كان ممن تقطعت به السبل أو تراكمت عليه الديون أو كان ممن توفرت فيه شروط دفع الزكاة إليه ، يجب على الدولة المسلمة أن توفر له حياة كريمة ومصونة من أموال الزكاة وغيرها من أموال بيت المال ما دام على هذا الوضع ، فإن تغير وضعه وحسن حاله أعادت النظر في شأنه وأمره .

 الزكاة ليست منحة ولا تفضلا ولا احسانا من المعطي ، بل هي فريضة محتمة وواجب شرعي وحق لازم في المال المزكى ، وفي التنزيل ﴿وَالَّذينَ في أَموالِهِم حَقٌّ مَعلومٌ ، لِلسّائِلِ وَالمَحرومِ ﴾ المعارج ٢٤-٢٥ . ﴿ وَفي أَموالِهِم حَقٌّ لِلسّائِلِ وَالمَحرومِ ﴾ الدوريات ١٩.

ولو كانت الزكاة منحة ومواساة من الأغنياء على الفقراء والمساكين  كما يعتقدها كثير من أرباب المال لما أباح الشارع أخدها بالقوة وبالإكراه وإضافة الزيادة عليها من أجل  الغرامة إمعانا في تنكيل وتحقير مانعها ، في الحديث (… من أعطاها مؤتجرا فله أجرها ومن أبى فإنا آخذوها وشطر ماله عزمة من عزمات ربنا ..) رواه أبوداود وغيره وهو صحيح.

ولأجل ذلك أعلن الصديق الأكبر رضي الله عنه الحرب على مانعي الزكاة واعتبرها من حقوق الإسلام التي لا تسقط بالتقادم ولا بالمنع ، بل يجب أخدها مهما كلف الأمر .

من المسؤول عن جباية الزكاة وتوزيعها على مصارفها ؟ .

تتولى الدولة المسلمة على جباية الزكاة وإيصالها لمستحقيها ، وأول من باشرها وطبقها أحسن تطبيق هو الرسول الأعظم صلى الله عليه وسلم ، ثم تولى بعده خلفاؤه الأربعة رضوان الله عليهم أجمعين،  وقد تطور في تنظيمها وتدوينها بصورة جلية في خلافة أمير المؤمنين عمر بن الخطاب رضي الله تعالى عنه ، حيث أسس  ديوان العطاء وما يحتاج إليه من آلية التنفيذ والتدقيق .

وبعد انتهاء زمن الخلافة الراشدة ومجيئ الدول العائلية وخروج الحكم عن مسار الشورى العامة وانحصاره في أيدي الأسرة الواحدة لم تعد سياسة المال –  الزكاة  – تخضع لقواعد الشرع الصحيح في إدارتها ، بل كانت تخضع لرغبات الحاكم وشهواته ، واستخدم مال الأمة في تثبيت أركان حكم الأسرة وشراء الذمم وصرفه إلى من لا يستحقه ومنعه من يستحق به .

وأما الدولة القطرية المعاصرة فليس في أجندتها وسياستها المالية أي ذكر للزكاة فضلا عن جبايتها وتوزيعها أو على الأقل توعية الناس في أهميتها ، بل همها الأكبر ينصب في تحصيل الضرائب وملحقاتها .

ولعدم وجود هيئة حكومية تتولى إدارة الزكاة يقوم أرباب المال بتوزيعها على مصارفها حسب استطاعتهم .

لماذا بيت الزكاة في الصومال ؟ .

معظم الصوماليين يؤدون زكاة أموالهم سواء كانوا في الحضر أو البدو ، ولا يوجد في البلد مؤسسة حكومية تتولى شأن الزكاة تحصيلا وتوزيعا ، كما لا يعرف المسكين أو المحتاج المستحق للزكاة كيفية حصول حقه ، وبأي جهة  يتوجه إليها ، ولذلك يضطر أصحاب الحاجات الوقوف بصفوف طويلة  أمام المحلات التجارية أو مكاتب المؤسسات والشركات أو أبواب بيوت التجار ورجال الأعمال من أجل حصول بعض الفتات من أموال الزكاة التي توزع هناك ، كأنهم شحاذين ومتسولين بصورة مهينة ومذلة تقدح مشاعرهم وتهين آدميتهم ، ومع هذا الذل والتعب لا يرجع  كثير منهم إلا بخفي حنين .

ولأجل حفظ واحترام كرامة الإنسان ولو كان محتاجا فقيرا ، وتغيير هذا الوضع البائس ينبغي السعي إلى إيجاد وسيلة وطريقة أفضل وأسهل لجباية الزكاة وتوزيعها على مستحقيها بصورة تليق بهم وتحفظ لهم أنفتهم وعزتهم .

يمكن تأسيس جمعية أهلية ( ليست خيرية حتى لا تختلط المهمات ولا تنحرف البوصلة) تعتنى شؤون الزكاة ، ويسبق قبل إعلانها بدء مشاورات موسعة مع  التجار ورجال الأعمال الصوماليين ثم يعقبها تقديم التماس التسجيل واستخراج الرخصة إلى الحكومة مع احاطة كبار مسؤوليها حول أهداف المؤسسة ومراميها لتكون أجهزة الحكومة على بينة من أمرها .

وبعد ذلك يبدأ وضع هيكلة المؤسسة وطريقة اختيار أعضائها وطاقمها الإداري – ولدي تصور أوليّ في كيفية وضع لمساتها الأولى –  وغير ذلك مما تحتاج إليه من معلومات ودراسات وبحوث تساعد في إنجاح مهمتها ، ثم يتم

بعد ذلك إشهارها وإعلانها للجمهور  .

هذا رأيي وهذه فكرتي فإن وُجد من يتبنى بها ويطورها أو يعدلها أو يأتي بأحسن منها فله مني جزيل الشكر والدعاء .
