المقدمة
أصدر المراجع العام الصومالي محمد محمود علي في التاسع من شهر أكتوبر/تشرين الأول الجاري تقريرا حول تحقيقات أجراها ديوان المراجعة العام في الأنظمة المالية الحكومية لعام 2018م. وتناول الدّيوان في تقريره عدّة محاور رئيسية حول إدارة الأموال التي حصلت عليها الحكومة في 2018م.
هذا، وقد أُجريت التحقيقات على مختلف مصادر الدّخل الحكومي الدّاخلية والخارجية، وأظهرت نتائج التّحقيقات فقدان أكثر من 18 مليون دولار أمريكي من المعونات الخارجية التي وصلت إلى خزينة الدّولة، في حين أشار التقرير إلى أن ما جمعته المؤسسات الحكومية الدّاخلية من مبالغ نقدية قد تم استهلاكها من قبل تلك المؤسسات، ولم تتمكّن الرقابة العامة معرفة طرق استهلاكها وفيما إذا كانت طرق شرعية وصحيحة، أو كانت طرق ملتوية وخاطئة.
ووفق ما جاء في تقرير الرقابة العامة فإنه كانت هناك أخطاء فادحة في إدارة النظام المالي الحكومي لعام 2018م، حيث يوضّح الجدول البياني لمدخلات الحكومة النقدية ومخرجاتها فرقا شاسعا بينها، رغم أنّه لم تتم الإشارة فيما إذا كانت هذه الأخطاء جاءت عن قصد أو دون قصد إلاّ أنها أكّدت على وجود خلل في إدارة النظام المالي الحكومي لعام 2018م.
هذا بالإضافة إلى ذلك، فقد جاء في التحقيق أن مساعدة مالية للحكومة الصومالية بقيمة 41,225,875$ تلقتّها من البنك الدّولي لم تتم إدارتها بشكل صحيح كما أفاد بذلك للمحققين مسؤولون في البنك الدّولي إلاّ أن التقرير السنوي المالي الأخير للحكومة أشار إلى أن مساعدات البنك الدولي للصومال عام 2018م كان مبلغها 49,007,950$ مما يعني وجود اختلاف بين الطرفين في رقم العدد الّذي جاء من البنك الدّولي كمساعدات مالية للصومال.
وجاء في التحقيق أيضا أن بعض المؤسسات الحكومية التي جمعت مقدارا من المال وقامت هي الأخرى باستهلاكه في خطوة مخالفة لقانون المحاسبة المالية للحكومة، لم يتم تضمينها في التقرير السنوي المالي الّذي أعدته الجهات المسؤولة عنها ويصل مجموع مصادر الدّخل الداخلي الذي تم استهلاكه من قبل المؤسسات نفسها إلى 1,350,400$ موزعة على المؤسسات والهيئات الحكومية الواردة أسماؤها في التقرير كما سيأتي.
وعلى الرّغم من تقديم هذه الصورة التي تظهر مدى الخلل الموجود في إدراة المساعدات المالية وغيرها من عائدات مصادر الدّخل القومي فإن التّحقيق لم يؤكّد على اختلاس هذه الأموال وصرفها في غير وجوهها الشرعية، لكنّ التحقيق أشار إلى إمكانية حدوث مثل هذا طالما أن إدارة النظام المالي لا تلتزم بالمعايير الدّولية لإدارة الأموال إذ ضرب مثالا لذلك أن التقرير السنوي المالي قدّم فقط كيفية إدارة الأموال التي وصلت إلى خزينة الدولة، ولم يشمل التقرير ما وصل إلى الحسابات الجارية للحكومة في البنوك الخارجية.
وأشار التقرير إلى وجود خطأ كبير يتمثل في أن المساعدات المالية التركية تأتي على شكل نقود يتم تسليمها إلى أشخاص بعينهم مما قد يؤدّي إلى عدم معرفة العدد الرسمي لهذه المساعدات وبالتالي سيسمح المجال لحدوث سيناريوهات متعددة، طالما أنه ليس هناك بيانات من البنك أو من الجهة المانحة، وتلك آفة تواجه إدارة النظام المالي في الحكومة الفيدرالية.
وردّا على ما جاء في تحقيق ديوان المراقبة العامة، فقد أفاد وزير المالية عبدالرحمن دعالي بيلة في مؤتمر صحفي عقده بمقديشو بأن التّحقيق قصّر في التّفاعل مع الجهات المعنية بالقضية حيث لم تشملهم المقابلات التي أجراها الدّيوان عند إجرائه هذا التّحقيق، مما يطعن في مصداقية ما جاء في التحقيق الّذي أجراه ديوان المراجعة العامة، مشيرا إلى أن بعض الأرقام الواردة في التحقيق أرقام خاطئة، وأنّ الأرقام التي وصفها التحقيق بالمفقودة سمّاها الوزير بالقيمة الباقية وأن إيصالات وبيانات المبالغ المصروفة متوفّرة في البنك المركزي وفي دوائر الوزارة، وأنّه كان يمكن الحصول عليها في حال البحث عنها عند إجراء هذا التحقيق.
وفيما يتعلّق بالأموال التي كانت يتم استلامها نقدا من الحكومة التركية على أيدي أشخاص، فقد أثبت الوزير صحة ذلك إلاّ أنه أضاف في مؤتمره الصحفي بإيقاف جميع المبالغ المالية التي كان يتم استلامها على شكل نقود من الدول والهيئات المانحة، وأن كلّ مساعدة مالية تصل الآن إلى الحكومة تمرّ عبر البنوك.
أولا: المخالفات الواردة في التقرير المالي الاتحادي للسنة المالية المنتهية 2018
لقد راجع المراجع العام البيانات المالية للحكومة الاتحادية الواردة في الصفحات من 13 إلى 29 والتي أعدها المحاسب العام كما هو مطلوب بموجب المادة 156 من الموافقة على لائحة الإجراءات المالية والمحاسبية للدولة 1962 (بصيغتها المعدلة في عام 1971) السنة المالية المنتهية في 31 ديسمبر 2018.
وذكر المراجع العام أن هذه البيانات المالية التي شملت، بيان الإيرادات والمدفوعات النقدية، وبيان التدفق النقدي، وبيان المقارنة بين الميزانية التقديرية والمبالغ الفعلية للسنة المالية المنتهية في 31 ديسمبر 2018 بالإضافة إلى ملخص حول السياسات المحاسبية الهامة والمعلومات التوضيحية الأخرى، لا تظهر رؤية حقيقية وعادلة حول جميع تلك الجوانب ووفق معايير المحاسبة الدولية في القطاع العام IPSAS (إصدار 2017).
ووأوضح المراجع العام أنه أجرى تدقيقه وفقًا للمعايير الدولية للأجهزة العليا للرقابة المالية والمحاسبية (ISSAI)، وفي إطار مسؤولياته بموجب القانون والدستور، مؤكدا استقلاله عن الكيانات الحكومية الأخرى وبصورة تراعى على اللوائح الداخلية لديوان المراجعة العام بجمهورية الصومال الفيدرالية.
وأشار إلى أن الغرض من عرض هذا التقرير هو لفت الانتباه إلى النتائج التي تم الكشف عنها أثناء التدقيق، والتي هي ناتج عن تدقيق البيانات المالية وعمليات تدقيق الامتثال التي أجرى ديوان المراجعة العام سابقًا المبين في تقرير منفصل الصادر في 30 يونيو 2019.
1- الإيرادات البالغة عددها 1،350،400 تم استخدامها دون تقرير مالي
كشف تقرير المراجع العام محمد محمود علي عن وجود إيرادات حكومية تبلغ قيمتها مليون وثلاثمائة وخمسين ألف وأربعمائة دولار أمريكي (1.350,400) دولار أمريكي جمعتها بعض الكيانات الحكومية وأعادت استخدامها مخالفة للائحة الإجراءات المالية والمحاسبية للدولة المادة 317 الفقرة 34 الصادرة عام 1961 وبصيغتها المعدلة عام 1972، وهذه الكيانات هي: وزارة النقل والطيران ( 86،980 دولار أمريكي )، جهاز التحقيقات الجنائية التابع للشرطة الصومالية (577014 دولار أمريكي ) . وكالة الأرصاد الجوية للطيران المدني الصومالية ( 130،130 دولار أمريكي) الجامعة الصومالية الوطنية ( 556276 دولارأمريكي).
وقال المراجع العام محمود علي إن الإيرادات البالغة عددها 1.350,400 دولار أمريكي لم يتم تضمينها في البيانات المالية الحكومية، وإنه لم يكتشف أثناء التدقيق عن أي مساءلة شاملة بشأن النفقات. لذلك فإن التقرير المالي الحكومي لم يذكر البيانات المالية المتعلقة بالإيصالات والنفقات ذات الصلة بهذه الإيرادات.

2- المساعدات الخارجية :
(أ) المساعدات الأوروبية: وبحسب تقرير ديون المراجعة العامة، لا يظهر في بيانات المالية الحكومية حول المساعدات التي حصلت عليها الصومال من الاتحاد الأوروبي مبلغا قدره 3.738 مليون دولار أمريكي. وهذا المبلغ يمثل الفرق بين حجم المساعدة المتوقعة من الاتحاد الأوروبي والمبالغ الفعلية التي صرفها الاتحاد لدعم الميزانية خلال عام 20188. حول الاتحاد الأوروبي إلى وزارة المالية الصومالية ما مجموعه 17,004,816 دولار أمريكي، في حين أن البيانات المالية المقدمة لهذا العام تظهر فقط 13,266,667 مليون دولار أمريكي، وهي المبلغ المودع في حساب الخزانة المركزية للحكومة الفيدرالية في الصومال.
لذلك، عندما نتحدث عن المساعدة الخارجية من الاتحاد الأوروبي فإن النقد وما في حكمه والفائض في الميزانية في نهاية العام المالي 2018 أقل من قيمتها بمبلغ قدره 3.738 مليون دولار أمريكي.
(ب) مساعدة خارجية من المملكة العربية السعودية
وظهرت في البيانات المالية الصادرة من الجهات المختصة مبلغا قدره 8670 6.070 دولار أمريكي فقط من أصل 20 مليون دولار من المملكة العربية السعودية ، وتلك كانت المبالغ التي تم تحويلها إلى البنك المركزي، في حين لم يذكر بقية الأموال البالغة 13،929،132 دولار أمريكي والتي كانت في مصرف بالخارج في التقرير المالي الحكومي السنوي. وبالتالي، فإن النقد والنقد المعادل، وفائض الميزانية (الأداء) في نهاية العام قد تم تخفيضها بمبلغ 13،929،132 دولار أمريكي فيما يتعلق بالمساعدة الخارجية المقدمة من المملكة العربية السعودية.
(ج)- المساعدة الخارجية من مكتب الأمم المتحدة لخدمات المشاريع (UNOPS)
لا يظهر في بيانات المالية الحكومية حول الدعم المالي الذي قدمها المكتب الأممي للشرطة الصومالية مبلغا قدره 719.451 دولار أمريكي، وهذا المبلغ يمثل الفرق بين حجم المساعدة المتوقعة من المكتب والمبالغ الفعلية التي حولها للوزارة المالية خلال السنة المالية 2018. حوّل المكتب إلى وزارة المالية ما مجموعه 1.254.743 دولار أمريكي في حين لم يظهر في الحسابات المالية سوى 535.292 دولار أمريكي ، وهو المبلغ المودع في حساب الخزانة المركزية للحكومة الفيدرالية.
(د)- المساعدة الخارجية من البنك الدولي لم تتم تسويتها:
جميع المساعدات المالية التي حصلت الصومال خلال عام 2018 من البنك الدولي لتمويل المشاريع المختلفة لا تتطابع مع البيانات التي أرسلها البنك الدولي لديوان المراجعة العام في الصومال. ذكر في بيانات البنك الدولي أنه حوّل إلى الوزارة المالية مبلغا قدره 41,225,875 دولار أمريكي خلال السنة المالية 2018 بينما توضح البيانات المالية الحكومية مبلغًا إجماليًا تم استلامه وقدره 49،007،950 دولار أمريكي، ولذلك يوجد عدم تطابق بين مساعدة البنك الدولي للصومال والنفقات التي لم يتم عرضها بشكل عادل.

(هـ)- ملخص أخطاء المساعدة الخارجية
من التحليل أعلاه، كانت المساعدة الخارجية للعام أقل من قيمتها 18.386.732 لأنه لم يتم نقل كل المساعدات الخارجية المقدمة إلى حكومة الصومال الفيدرالية على الفور إلى حساب الخزانة المركزية ليبلغ عنها مكتب المراجع العام. لذلك، كان النقد وما في حكم النقد وأداء الميزانية (الفائض) للسنة المنتهية في 31 ديسمبر 2018 بأقل من قيمته البالغة 18،386،732 دولار أمريكي.
ثانيا: مسائل التدقيق الرئيسية
(أ)- الأموال المخصصة للمشروعات ونفقاتها: هناك عدد من المشروعات يتم تمويلها من قبل المساعدات التي تأتي من الخارج. ولا يوجد تقارير مالية تم إعدادها خصيصا لتلك المشاريع، وأن نفقاتها يتم إدراجها في بند السلع والخدمات و في بند استخدامات الأصول غير المتداولة ( Non Current Assets).
ثالثا: مسائل أخرى:
أ. المال العام والديون : وقال تقرير المراجع العام، كان من الواجب تقديم تقرير عن المال العام والديون بموجب المادة 156 من لائحة الإجراءات المالية والمحاسبية للدولة لعام 1962 وبصيغتها المعدلة عام 1971، وفيما يبدو لم يتم الالتزام بالقانون طالما لم يشمل التقرير المالي الحكومي بند المال العام والديون.
ب. الخزينة المركزية : البيانات المالية المعروضة هي للحسابات المصرفية في الخزانة المركزية للحكومة الفيدرالية والتي تعمل مع البنك المركزي الصومالي. لذلك، لا يتم تضمين المعاملات في الحسابات المصرفية غير الموجودة في الخزانة الموحدة في هذه البيانات المالية، مثل الحسابات المتبقية من المساعدات التي جاءت من الاتحاد الأوروبي والمملكة العربية السعودية ومن مكتب الأمم المتحدة لخدمات المشاريع المذكور أعلاه.
ج. تقرير تدقيق الامتثال للسنة المنتهية 2018: أود أن ألفت انتباهكم إلى تقرير تدقيق الامتثال لمكتب المحاسب العام للسنة المنتهية في 31 ديسمبر 2018. وهذا مدرج في تقرير تدقيق الامتثال الموحد للكيانات التابعة للحكومة غير الأمنية. صدر التقرير في 30 يونيو 2019 تحت غطاء منفصل، ويوضح بالتفصيل قضايا الرقابة الداخلية.
رابعا: توصيات
- ينبغي إدراج جميع أموال الحكومة المحتفظ بها في مختلف الحسابات البنكية، سواء كانت في الخزانة المركزية أو في الحسابات السنوية للحكومة الفيدرالية في الصومال.
- يجب إعادة تكوين أنظمة معلومات الإدارة المالية الصومالية SFMIS لالتقاط جميع المعاملات لجميع الحسابات المصرفية لحكومة الصومال الاتحادية أينما كانت.
- يجب أن يتمتع مكتب المراجع العام بوصول مباشر إلى جميع هذه الحسابات البنكية لتمكينه من إعداد حسابات سنوية لحكومة الصومال الفيدرالية تظهر أداءً ماليًا حقيقيًا وعادلًا وتدفقات نقدية للحكومة.
- يجب تسجيل جميع المعاملات بالقيمة الإجمالية لأن المبالغ المقاصة لا يسمح بها بالمعايير المحاسبية، إلا في حالات محددة نادرة.
- يجب أن يتم استلام الأموال العامة، ولا سيما المساعدة الخارجية، من خلال الأعمال المصرفية بدلا من تلقي النقدية وتحويلها نقدا للبنوك. وهذا يقلل من مخاطر خسائر الأموال من خلال الخطأ والإغفال والعمولة. ويقلل أيضا من خطر غسل الأموال.
- خلال التدقيق تم تلقي مساعدة خارجية من تركيا بقيمة 20 مليون دولار أمريكي للسنة المنتهية في 31 ديسمبر 2018 نقدًا وتم إيداعها نقدًا. ووجدنا أنه لا يوجد مسار تدقيق مستقل لمبلغ استلام المساعدة الخارجية من تركيا. هناك خطر من أن المساعدات الخارجية المقدمة من تركيا لم يتم تحويلها إلى حساب في الخزانة المركزية في الوقت المناسب. ويمكن أن يتعرض الضباط الذين شاركوا في هذه المعاملات النقدية لخطر تهمة غسل الأموال.
